Terms of Service — Creators

1. Platform and Independent Creators

Fansilo.io is a technology platform operated by Fansilo LLC that provides tools for creators to build profiles, host and deliver digital content, gate access behind purchases, receive payments, and manage related services.

You are an independent user and seller. You are not an employee, agent, partner, or joint venturer of Fansilo, and nothing in these Creator Terms creates such a relationship. You act on your own behalf and are solely responsible for your content, your storefront, your representations, and your conduct.

2. Eligibility and Creator Accounts

To sell on Fansilo.io you must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater), have the legal capacity to enter into contracts, and not be barred from using the service under applicable law.

A creator account is required to publish content. You may operate one or more creator profiles under a single authenticated account, and each profile remains associated with, and owned by, that account.

3. Account Security and No Account Sharing

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Use a strong, unique password and enable available security features.

You may not sell, transfer, lease, or share your account or profiles with any other person, and you may not allow another person to upload or sell content under your identity. Notify us promptly at legal@fansilo.io of any suspected unauthorized access.

4. Accurate Information

You agree to provide true, current, and complete information during registration, identity verification, and payout setup, and to keep that information up to date. Providing false, misleading, or fraudulent information may result in suspension or termination and may forfeit disputed earnings.

5. Creator Responsibilities

As an independent creator, you are solely responsible for:

• the content you upload and everything you publish or communicate through Fansilo.io;
• owning that content or holding all rights, licenses, and authorizations needed to use and sell it;
• obtaining and retaining all required permissions, consents, and model releases from every person who appears in or contributes to your content;
• the legality of your content and activities in every jurisdiction where you offer or deliver it;
• your titles, descriptions, previews, pricing, and any representations or promises you make to customers;
• your taxes and any regulatory, licensing, or reporting obligations that apply to you; and
• responding to and resolving any claim, dispute, or demand arising from your own content or conduct.

6. Content Ownership

As between you and Fansilo, you retain all ownership rights in the content you create and upload. Fansilo does not claim ownership of your content.

7. Creator License to Fansilo

You grant Fansilo LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, transcode, create previews or thumbnails of, display, and transmit your content solely as necessary to operate, secure, promote, and improve Fansilo.io and to deliver purchased content to authorized customers.

This license exists to run the service (for example, generating blurred previews and delivering originals to verified buyers) and ends for new distribution when you remove content or your account is terminated, except to the extent retention is required by law, needed to complete transactions already in progress, or necessary for backups, security, dispute resolution, or legal compliance.

8. Customer Access License

When a customer completes a verified purchase, you grant that customer a limited, personal, non-transferable, non-sublicensable license to access and view the purchased content for their own personal use, subject to the Customer Terms. Customers do not acquire ownership and may not copy, redistribute, resell, or publicly share your content.

9. Permitted Content

You may upload and sell content that you own or are authorized to distribute, that features only verified, consenting adults, and that complies with these Creator Terms, our Creator Guidelines, our Consent & Model Release policy, our Anti-Trafficking policy, and applicable law. Supported content types on Fansilo.io include photos, videos, and behind-the-scenes material within the platform's stated upload limits.

10. Prohibited and Illegal Content

You must not upload, sell, or link to content that is illegal or that violates our policies, including but not limited to:

• any content involving a minor or the sexualization of minors;
• non-consensual content, or content depicting a person who has not given informed, documented consent;
• content produced through trafficking, coercion, exploitation, or blackmail;
• content you do not own or are not authorized to distribute, including infringing or stolen material;
• content that depicts non-consensual violence, or that facilitates crime, fraud, or harm;
• content that discloses another person's private information without authorization; and
• content that otherwise violates applicable law or our published policies.

11. Ownership, Consent and Authorization

Before uploading, you represent and warrant that you own or have obtained all rights, permissions, consents, and releases necessary to create, publish, and sell the content, and that every individual featured is a verified adult who has consented to the creation and distribution of that content on Fansilo.io.

You agree to keep age-verification and release records and to provide them to Fansilo promptly upon request as part of compliance review.

12. Copyright and Intellectual Property

You must respect the intellectual property rights of others and only upload material you are entitled to use. Fansilo responds to valid notices under our DMCA Policy and may remove content and act against repeat infringers.

13. Creator Responsibility for Uploaded Content

You are fully and independently responsible for all content you upload and for any consequences of publishing or selling it. Fansilo does not pre-approve content and does not assume responsibility for your independent acts, representations, ownership claims, permissions, or unlawful conduct.

14. Content Moderation

Fansilo may, but is not obligated to, review, moderate, restrict, label, or remove content and may use automated and human review. Moderation does not transfer responsibility for your content to Fansilo and does not make Fansilo the author or publisher of your content.

15. Reports and Removal

Fansilo may act on reports submitted through our Report Abuse process or on its own initiative. We may remove content, restrict features, withhold disputed funds, suspend profiles, or take other action where we reasonably believe content or conduct violates these Creator Terms, our policies, or the law.

16. Platform Fees

Fansilo charges a platform fee on sales as described below. Payment processors may separately apply their own processing fees, which are disclosed where applicable. Fansilo does not charge additional fees beyond those disclosed to you.

17. Creator Earnings

Your earnings are calculated by Fansilo from verified, completed transactions recorded in the platform ledger, which is the source of truth for financial calculations. Earnings may be adjusted for refunds, chargebacks, disputes, or reversed or fraudulent transactions.

18. 30% Fansilo Platform Fee

Fansilo retains a platform fee of thirty percent (30%) of the sale price of each qualifying transaction. This fee supports hosting, payment facilitation, security, moderation, and continued operation of Fansilo.io.

19. 70% Creator Share

You receive a creator share of seventy percent (70%) of the sale price of each qualifying transaction, calculated on the ledger and subject to applicable payment-processing fees, refunds, chargebacks, holds, and adjustments described in these Creator Terms.

20. Payouts

Payouts of your available balance are made through supported payout methods after you complete required identity verification and meet the platform's minimum payout threshold and any applicable hold period. Pending balances are not withdrawable until they become available, and a payout may not exceed your available balance.

Payout timing may depend on third-party providers. Fansilo may withhold, delay, or reverse payouts in connection with suspected fraud, disputes, chargebacks, policy violations, or legal requirements.

21. KYC / Verification

Identity verification (KYC) is required before you can receive payouts and may be required to continue selling. Verification is account-level and handled by trusted third-party providers. You agree to provide accurate identity information and to complete additional verification if requested. Fansilo keeps the identity information it stores to the minimum necessary and does not make it public.

22. Taxes

You are solely responsible for determining, reporting, and paying all taxes and duties arising from your activity on Fansilo.io. Where required by law, Fansilo may collect tax information from you and may report or withhold amounts as legally required. You are responsible for your own tax registration and compliance.

23. Refunds

Refunds are handled in accordance with Fansilo's policies and applicable law. Where a refund is issued, the corresponding creator share and platform fee are reversed on the ledger, and your balance is adjusted accordingly.

24. Chargebacks and Payment Disputes

If a customer initiates a chargeback or payment dispute, the disputed amount and related fees may be reversed or held pending resolution. Excessive chargebacks or disputes associated with your content or conduct may result in holds, withheld payouts, suspension, or termination.

25. Third-Party Payment Processors

Payments and payouts are facilitated by third-party payment processors, and your use of them may be subject to their own terms. Fansilo does not store full card details. Fansilo is not responsible for the acts, omissions, availability, or decisions of third-party processors, though we will make reasonable efforts to support legitimate transactions.

26. Fraud Prevention

To protect creators, customers, and the platform, Fansilo may use fraud- and risk-detection measures and may delay, hold, reverse, or decline transactions or payouts, and may require additional verification, where fraud, abuse, or policy violations are suspected. Attempting to manipulate payments, transactions, balances, or chargebacks is prohibited.

27. Account Suspension

Fansilo may suspend your account, a profile, or specific features, and may withhold disputed funds, where we reasonably believe you have violated these Creator Terms, our policies, or the law, or where suspension is necessary to protect users, the platform, or third parties, or to comply with legal requirements.

28. Account Termination

Fansilo may terminate your account or profiles for material or repeated violations, illegal activity, fraud, or where required by law, with or without prior notice depending on the circumstances. You may stop using Fansilo.io and request account closure at any time, subject to outstanding obligations.

29. Effect of Termination

Upon termination, your right to use Fansilo.io ends and your content may be removed from public availability. Verified amounts properly owed to you remain payable subject to holds, disputes, verification, and legal requirements. Provisions that by their nature should survive termination will survive, including ownership, licenses granted for completed transactions, indemnification, disclaimers, and limitations of liability.

30. Indemnification

You agree to indemnify, defend, and hold harmless Fansilo LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your content, your representations, your breach of these Creator Terms or the law, your infringement of any third party's rights, or your independent acts or conduct.

31. Limitation of Liability

To the maximum extent permitted by law, Fansilo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of Fansilo.io. Nothing in these Creator Terms limits liability that cannot be limited under applicable law.

32. Disclaimers

Fansilo.io is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the extent permitted by law. Fansilo does not warrant that the service will be uninterrupted, error-free, or secure. Fansilo does not assume responsibility for a creator's independent acts, representations, ownership claims, permissions, or unlawful conduct, and this does not mean Fansilo has no obligations under applicable law.

33. Governing Law and Dispute Resolution

These Creator Terms are governed by the laws of the United States and the state in which Fansilo LLC is organized, without regard to conflict-of-laws rules, except where mandatory local law applies to you. The parties will attempt to resolve disputes informally first; unresolved disputes will be handled through the venue and process designated by Fansilo to the extent permitted by law. Nothing here waives rights that cannot be waived under applicable law.

34. Law Enforcement Requests

Fansilo retains the right to preserve information and to cooperate with lawful government and law enforcement requests, and to disclose information in response to valid legal process or where an emergency involving risk of serious harm exists, as described in our Law Enforcement Policy.

35. Changes to Terms

Fansilo may update these Creator Terms from time to time. When we make material changes, we will update the “last updated” date and may provide additional notice. Your continued use of Fansilo.io after changes take effect constitutes acceptance of the updated Creator Terms.

36. Entire Agreement

These Creator Terms, together with the policies referenced within them (including the Privacy Policy, DMCA Policy, Creator Guidelines, Consent & Model Release, Anti-Trafficking Policy, and Law Enforcement Policy), constitute the entire agreement between you and Fansilo LLC regarding your use of Fansilo.io as a creator and supersede prior agreements on that subject. If any provision is held unenforceable, the remaining provisions remain in effect.
